Chapel Hill Mayor Mark Kleinschmit and the town council have voted to appeal Judge Orlando Hudson’s decisions that invalided their government-knows-best cell phone ban and unconstitutional ordinance that would have regulated towing by putting putting an arbitrary cap on what a private company can charge for its service.

Gotta be more to that towing ban decision. “Hudson ruled that the town’s towing ordinance is unconstitutional because local governments do not have the authority to regulate trade” doesn’t seem right. Cause I know of lots of instances where they DO regulate (or at least have in the past). Does anyone have a link to that decision? It seems to me that this ruling hits conservatives as hard as it does liberals — perhaps worse? Donna, you have any more info on this?
